Hungary introduced its new insolvency régime in 1991, after the transition. The paper gives a historical background about the circumstances of the introduction of the insolvency act. In the pre-transition era insolvency law was not important at all, because of the proportion of state ownership: almost everything which has monetary value had owned by the state. In a scenario where both the creditor and the debtor is owned by the same entity, it is pointless to liquidate the debtor because of its failure to pay its debt. The new insolvency code was based on the practice of the Metropolitan Court. The code has been modifi ed several times, including signifi cant changes due to the European Union accession and the 2008 recession. The paper also analyzes the declaration of insolvency and the liquidator’s right to challenge the validity of the debtor’s agreements concluded before the declaration of insolvency.
