The conception of the constitutional criminal law originates from the dogmatics of the French law. This conception includes all the guarantees of criminal law, including the substantive law, the law of criminal procedure and the penal law (e. g. principles of nullum crimen sine lege, nulla poena sine lege, presumption of innocence etc.). Many decisions of the Constitutional Court of Hungary were concerned with several elements and requirements of constitutional criminal law. This paper gives details of the practice of the Constitutional Court which aff ects the presumption of innocence, the proceeding of against a defendant in absentia, clarity of norms, and the principles of nullum crimen sine lege and nulla poena sine lege.
